1. Description of the Its Our Time Promotion

AT&T’s #ItsOurTime Promotion (the “Promotion”) is designed to salute Team USA at the 2014 Winter Olympics. You can participate in the Promotion by submitting a video of yourself chanting the letter “U” or “S” or “A” using one of the methods described below (“Video”). AT&T will post all eligible Videos on the It’s Our Time microsite located at att.com/TeamUSA for public viewing and will display and exhibit select Videos in other public media. pan>AT&T will also select certain Videos, in its sole discretion, to be included as part of a montage of Videos that will be featured in a national television commercial. Videos may be submitted beginning 12/31/2013 and ending 2/28/2014 (the “Promotion Period.”). By submitting a Video you agree that AT&T may use your Video as set forth in these Rules and agree to be bound by these Rules and the It’s Our Time microsite Terms of Use and all decisions of AT&T.

2. Eligibility

You must be a legal resident of the fifty United States or the District of Columbia and have reached the age of majority in your state of residence (18, except 19 in AL and NE, and 21 in MS) in order to be eligible to submit a video.

3. How to Submit a Video

There are two ways to participate in the Promotion and submit a Video:

1. You may create and submit a Video using the #ItsOurTime mobile application (the “App”). The App may be downloaded from the iTunes or the Google Play App stores. Once you have downloaded the App, you will be required to complete a submission form and a Media Consent & Release Agreement (“Consent Agreement”) granting to AT&T the rights to use your Video, including your name and likeness in the manner set forth in these Rules. Once you have completed the Submission form and Consent Agreement you will be provided with instructions for recording your video. You will be asked to show your support for Team USA at the 2014 Winter Olympics by chanting the letters “U”, or “S”, or “A” (no other letters or words) in English in a recorded Video through the App and to submit your Submission form, Consent Agreement and Video through the App (collectively your “Submission(s)”). Message and data charges may apply.
2. You may also create and submit a Video by visiting one of the AT&T #ItsOurTime Video Booths that will be featured at various live events throughout the Promotion Period. For information on when and where the #ItsOurTime Video Booths will be featured visit att.com/TeamUSA. You will be required to complete a Submission form and Consent Agreement as described above, at the video booth. Once you have completed the Submission form and Consent Agreement you will have the opportunity to record a video of yourself chanting the letters “U” or “S’ or “A” at the AT&T Video Booth.
3. All Submissions must be received no later than February 28, 2014. Provided your Submission(s) complies with the Guidelines in paragraph 4 below, AT&T may, in its sole discretion, post your Submission(s) for public viewing at the #ItsOurTime website. All information you submit will be treated in a manner consistent with the #Its Our Time Terms of Use.

3. Video Submission Guidelines

You may only chant the letters “U”, “S”, “A” in your video(s) in the English language, your video(s) must be solely your original creation(s) and you must appear alone in the Video. pan>Videos may not include music, even if original, or display written words in any form, contain any material that contains sexual explicitness, drugs or alcohol use, violence of any form, any firearms, or depict any commercial products or services. pan>They may not promote any unsafe activities, may not have been commercially released, or include any sounds or images deemed inappropriate by AT&T in its sole discretion. They may not include any copyrighted or trademarked material or infringe on the intellectual property rights of any party. pan>AT&T reserves the right not to post or consider any Submission(s) for any reason it deems sufficient in its sole discretion.

By entering a Submission you warrant that you have the absolute power to transfer your rights in your Submission to AT&T, pursuant to paragraphs 4 and 5 below.

4. Use of Videos

AT&T will view all qualified Videos and decide, in its sole discretion, whether to post them for public viewing on the att.com/TeamUSA website. In so doing it may edit, modify or add additional content to your Submissions or use them in conjunction with other Submissions that it may select. AT&T may request that you modify your Submission(s) before it posts for public viewing or includes in any advertising

In addition, AT&T may use, display, broadcast or exhibit the Videos and/or any portions or excerpts thereof in any manner including advertising, promoting and publicizing the Promotion (and/or AT&T products and service) in any and all media, including but not limited to television, radio, print, the internet and billboard advertising. Without limiting the generality of the foregoing, AT&T will in its sole discretion select certain Videos from among all eligible Videos received for display on public billboards and for inclusion in a national television commercial featuring a montage of Videos submitted saluting Team USA. The determination as to which and how many Videos will be featured in the television commercials and/or in other media will be made by AT&T in its sole discretion. AT&T’s determinations will be final and binding. By submitting a Video you understand and agree that your Video may be publicly displayed in the manner set forth above without any further notification to or consent from you.

5. Transfer of Rights

In exchange for your participation in this Promotion, you hereby transfer all your rights, title and interest in your Submission(s) to AT&T and its designees, including the right to edit, adapt, reformat, modify, combine with other materials and create derivative works, and you agree that AT&T or its designees may use, display , broadcast, transmit and publicly perform your Video, and use your name and likeness in connection therewith in any and all media in the manner set forth in paragraph 4 without geographic or time limitation and without additional compensation to you.

6. General Terms

AT&T reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion at any time for any reason and/or the right to modify or amend these Rules. By participating in the Promotion, you hereby release and hold harmless AT&T and its designees from and against any and all claims, injuries or damages relating to your participation in the Promotion, including without limitation claims based, on defamation, publicity rights, invasion of privacy, copyright infringement, or any other intellectual property cause of action.
